House Sends Senate Right-to-Try Bill to President’s Desk

The House of Representatives passed “right to try” legislation in a 250-169 vote despite warnings from House Democrats it would chip away at FDA authority.

The bill, sponsored by Sen. Ron Johnson (R-Wisc.) and already passed by the Senate, would authorize patients with life-threatening conditions and no alternate treatments to use drugs that have passed preliminary testing but have not yet received FDA approval.

To qualify, patients also must be ineligible to participate in a clinical trial for a drug to treat their condition. The bill passed the Senate unanimously after Johnson vowed to delay reauthorization of FDA user fees unless the bill was considered.
