Ohio AG Anticipates ‘Major Litigation’ Against PBMs

Ohio Attorney General Mike DeWine said he expects an ongoing investigation into the practices of pharmacy benefit managers that conduct business with state agencies to result in major lawsuits against PBMs.

The investigation, which began at the end of 2017, is looking into PBMs and their contracts with state agencies and state pension systems. DeWine said that the conduct of the PBMs towards the agencies “remains a major concern.”

He said he is “putting the PBMs on notice that their conduct is being heavily scrutinized, and any action that can be taken and proven in court will be filed to protect Ohio taxpayers and the millions of Ohioans who rely on the pharmacy benefits provided.”
