OIG Finds Medicare Overpaid Liberty Medical for Inhalation Drugs

August 23, 2018

Liberty Medical received an estimated $47,000 in unallowable Medicare payments for inhalation drugs, according to a report from the HHS Office of Inspector General.

In calendar years 2015 and 2016, Medicare paid about $1.3 billion for inhalation drugs provided to Medicare beneficiaries and Liberty was among the 20 suppliers receiving the most in Medicare payments during the audit period. OIG analyzed 100 claim lines and found that six were not compliant because Liberty did not provide adequate proof-of-delivery for two claim lines or provide medical records for four.

OIG called on Liberty to refund the estimated overpayments and to “exercise reasonable diligence” to identify any other overpayments outside of the audit period.
