Matrixx Hit With Patent Infringement Suit Over Zicam

Trutek has filed suit in a federal court against Matrixx Initiatives, alleging breach of contract and patent infringement by Matrixx’s OTC nasal spray Zicam.

The complaint alleges that the Zicam branded products for relief of colds and allergies infringed on four of Trutek’s patents targeting an “electrostatically charged nasal application product.”

The lawsuit in the U.S. District Court for New Jersey claims that, in 2011, Matrixx entered into a series of licensing contracts whereby Trutek agreed to disclose confidential patent details and trade secrets to Matrixx provided it did not attempt to profit from the information.
