Dr. Reddy’s, Hospira Asks Appeals Court to Re-Hear Alimta Patent Case

Dr. Reddy’s and Hospira have asked a federal appeals court to reconsider a patent infringement ruling regarding Eli Lilly’s cancer drug Alimta (permetrexed). 

A three-judge appeals court panel upheld an Indiana circuit court ruling that the generic drugmakers infringed on Eli Lilly’s vitamin regimen patent for Alimta.

Eli Lilly filed separate suits against the generic manufacturers in 2016 in the U.S. District Court for the Southern District of Indiana, arguing that their ANDAs infringed on its patent. The cases went to a bench trial in 2017 and the district judge ruled in Eli Lilly’s favor.
