Chembio Diagnostic Systems Awarded $2.7 Million Damages Against BioSure

Chembio Diagnostic Systems has received a $2.7 million arbitration award against BioSure (UK), a former UK distributor of the company’s HIV self-tests.

The companies entered into a distribution agreement in April 2014 under which BioSure was licensed to sell bundled products in the UK containing Chembio’s Sure Check HIV 1/2 pouched tests. The distribution agreement ended on April 1, 2019.

In September 2019, Chembio began arbitration proceedings in New York, alleging BioSure breached the distribution agreement, misappropriated Chembio’s trade secrets and engaged in other unlawful conduct. A final merits hearing was held in April 2021, and now BioSure has been assessed the damages.
