Judge Tosses Out Pfizer Chantix Lawsuit

A federal court in New York has thrown out a proposed class-action lawsuit against Pfizer over the drugmaker’s alleged failure to disclose that its smoking cessation product, Chantix, contained N-nitroso-varenicline, a likely carcinogen.

The two plaintiffs, Roslyn Harris of New Jersey and Mary Allen of New York, claimed that they would not have purchased Chantix if they had known about the contamination.

But U.S. District Judge Denise Cote of the Southern District of New York didn’t find evidence that Pfizer misled consumers with its product labeling.

Pfizer recalled Chantix in July 2021 for possible contamination with the carcinogen nitrosamine and later extended the recall through September 2021.
