Philips BiPAP, CPAP, Ventilators Restricted From Production Under Consent Decree

A consent decree of permanent injunction against Philips Respironics restricting the production and sale of new CPAP and BiPAP machines and mechanical ventilators at three U.S. facilities has been entered by the U.S. District Court for the Western District of Pennsylvania.

The three facilities — located in Pennsylvania in Mt. Pleasant, Murrysville and New Kensington — are prohibited from manufacturing the devices until certain conditions are met.

Philips and the FDA had agreed to the terms of the consent decree in January following an analysis from the Pittsburgh Post-Gazette and ProPublica that found Philips withheld over 3,700 complaints about the machines from the FDA for more than 11 years.
