Tyco Unit to Appeal Antitrust Verdict

March 25, 2005

The Nellcor unit of Tyco International said that it would appeal a $420 million award that it was ordered to pay for engaging in anticompetitive behavior in the market for machines that measure the oxygen content in blood. Nellcor, based in Pleasanton, Calif., owes Masimo $140 million for the anticompetitive behavior, a Los Angeles court jury ruled. The verdict is automatically tripled to $420 million under antitrust law, said Marc Seltzer, a lawyer for Masimo.
