Australia Court Upholds Dusa Patent Claim

A federal court in Australia upheld Dusa Pharmaceutical's patent for a dermatological treatment, but the court also said PhotoCure's competing product, Metvix does not infringe on its Australian patent claims. Dusa and Norway-based PhotoCure ASA, two companies have been trying to mediate their disputes since last summer, have one month to file appeals. In a press release, Dusa said it will review the court's opinion over the next few days. In a statement, Dusa's chairman and CEO Dr. Geoffrey Shulman said the ruling will not impact the company's operations because Dusa has no active drug application in Australia.
