Boston Scientific Wins Patent Suit Against J&J

June 10, 2005

A court in the Netherlands ruled that a number of Cordis catheters infringe on a patent protecting Boston Scientific's balloon catheter.

Boston Scientific was awarded the right to damages, and the court has ordered Cordis, a subsidiary of Johnson & Johnson, to stop selling or making any of the infringing catheters in the Netherlands. Cordis said it will have to cease production of the balloon catheters at its plant in Roden, Netherlands, which supplies catheters to markets outside the U.S.

The Cordis products that the court said infringe on Boston Scientific's patent include the Cypher, Raptor, Cypher Select, Bx Velocity Raptor, Bx Sonic, U-Pass and Aqua T3. Cordis said the ruling will not affect supply of the Cypher product in the U.S. The company said it plans to appeal the ruling.
