JURY FINDS BOSTON SCIENTIFIC INFRINGED J&J PATENTS
A U.S. District Court jury in Wilmington, Del., found that Boston Scientific's Taxus drug-eluting stent and its Liberté and Express bare-metal stents infringe Cordis' patent for its balloon-expandable stent. Cordis is a Johnson & Johnson (J&J) subsidiary.
The jury also found Boston Scientific infringed an additional Cordis patent - one covering flexible stent technology - with its Liberté stent. J&J said it would assert a patent claim against the drug-eluting version of the Liberté stent once the product is launched.
In this judgement, the jury only determined liability. A trial scheduled to begin in August will determine the amount of damages Boston Scientific owes Cordis for its infringement and whether such infringement was willful. Boston Scientific plans to appeal both rulings.
