UTAH MEDICAL COMMENTS ON DISMISSAL OF FDA SUIT

Utah Medical (UTMD) argues that a federal court's recent dismissal of the FDA's proposed injunction against the company over alleged quality system violations shows that the agency's efforts were irresponsible. Meanwhile, UTMD is continuing its own claim against the FDA.

The U.S. District Court for the District of Utah recently threw out the FDA claim, finding no quality system violations. UTMD responded to the decision by criticizing the agency's efforts, calling the lawsuit a "gross misuse of public resources" that "was the product of major system deficiencies within the FDA."

The company also pledged to continue its administrative claim against the agency, alleging abuse of process and seeking restitution of litigation costs and lost profits. HHS has until approximately Jan. 15, 2006 to consider the claim.
