MEXICO TO RELAX DRUG ADVERTISING LAWS

February 10, 2006

The research-based drug industry in Mexico is set to benefit from a relaxation of the ban on advertising prescription pharmaceutical products. Although there has yet to be specific legislation on the matter, recent events have given the impression that the Health Secretariat is adopting a more liberal approach. For example, US drugmaker Wyeth has been permitted to openly market a new vaccine.

A new law is being planned that will permit advertising for specific therapeutic categories of prescription drugs, while the promotion of OTC drugs is already allowed in the country. However, the use of promotional materials for prescription drugs that are not directly administered by doctors will still be regulated closely.

Drug companies in Mexico have welcomed the move, claiming that consumers benefit from freedom of information and want more influence over their treatment. However, some officials still feel that advertising downplays the safety of drugs and that strict controls remain necessary.
