WYETH FILES PATENT SUIT AGAINST IMPAX

April 19, 2006

Wyeth Laboratories has filed a patent infringement lawsuit in a federal district court against Impax Laboratories over Wyeth's antidepressant Effexor XR, according to Impax.

Wyeth filed its suit in the U.S. District Court for the District of Delaware, alleging the generic version of Effexor XR that Impax plans to market violates Wyeth's '830 patent.

Impax has filed an abbreviated new drug application with a Paragraph IV certification to market generic Effexor XR (venlafaxine HCl) in 37.5-, 75- and 150-mg dose capsules, Impax said.
