FDA Loses Major Case Testing its Enforcement Discretion Authority
A D.C. Court of Appeals has ruled that the FDA may not exercise enforcement discretion in importing unapproved variants of drugs from abroad. The drug in question, sodium thiopental, is used to perform executions on death row inmates.
