Federal Judge Throws Out Part of ADHD Suit Against Actavis and Shire
A federal court in Massachusetts threw out a proposed class-action lawsuit by consumers against Actavis and Shire over pay-for-delay allegations but said direct buyers may still argue their case.
The two drugmakers were accused of using pay-for-delay deals to keep generic versions of extended-release Intuniv (guanfacine hydrochloride) — commonly used to treat young patients with ADHD — off the market.
The lawsuit in the U.S. District Court for Massachusetts alleges that Intuniv’s name brand manufacturer Shire entered into anticompetitive agreements with Actavis in 2013.
