Alabama Supreme Court: Brand Drugmakers Can Be Held Liable for Generic-Drug Labeling

A brand-drug maker can be held responsible for warning labels on a product it did not produce if those warning labels are drafted by the brand company and merely repeated by generic manufacturers, the Alabama State Supreme Court has ruled. The court held that Pfizer can be sued by a patient who suffered injuries due to long-term use of a generic version of its heartburn drug Reglan (metoclopramide HCl).
