Pennsylvania Court Rules Generic Price-Fixing Litigation Can Go Ahead
A Pennsylvania federal court ruled that more than 20 generic drugmakers must face multidistrict litigation accusing them of a price-fixing conspiracy — but not Teligent.
In an Oct. 16 ruling, Judge Cynthia M. Rufe of the Eastern District of Pennsylvania said the evidence of concerted actions supported the allegations of “a traditional conspiracy.” But the judge found insufficient evidence that Teligent had conspired with Perrigo and Taro over the price of the antifungal drug econazole.
Rufe wrote that the plaintiffs “have not sufficiently alleged that Teligent had an opportunity to conspire with the other econazole defendants,” dismissing their claims with leave to amend.
